IMPORTANT – READ CAREFULLY

 ENROLLMENT TERMS AND CONDITIONS

 

Thank for your interest in taking our online driving safety course. By clicking the “ACCEPT” button at the bottom of this contract, the student indicates that he or she understands the terms and conditions of said contract and is contractually bound to them.

 

Defensive Driving Solutions Inc. (CP585), hereinafter referred to as the “COURSE PROVIDER” hereby agrees to provide to the undersigned party, hereinafter referred to as “STUDENT”, six hours of driver safety instruction (COURSE) through  www.DefensiveDrivingSolutionsInc.com, a licensed driving safety school, upon receipt of payment.

 

Grading and Progress Policy

STUDENTS are responsible for completing the course material and passing the final exam. The COURSE will have course questions relating to the course material that are spread through the COURSE. The final exam will consist of 20 questions and a minimum passing grade of 70 percent will be required in order to receive a certificate of course completion. STUDENTS will receive a total of three attempts to secure the minimum passing grade requirement.  In the event of three failed attempts, STUDENTS will be prevented from completing the COURSE. Therefore, a review of the course material is recommended prior to taking the final exam.

STUDENTS will also be asked 20 personal validation questions based on driver’s license and license plate information they entered during the registration process. If a STUDENT misses a total of 7 personal validation questions, then STUDENT will be prevented from completing the COURSE.

 

Completion and Your Certificate

Upon completion of COURSE requirements, STUDENT certificate will be mailed in accordance with the shipping method STUDENT selects. STUDENT certificates will be mailed on the day of completion if all COURSE requirements are met by 3 pm CST, excluding weekends and holidays. For COURSES completed after 3 pm CST, certificates will be posted on the next business day.

 

Privacy Statement

The COURSE PROVIDER is the sole owner of the information collected on this site. The COURSE PROVIDER collects information from its users at several different points on the website. The COURSE PROVIDER will not use or sell this information to promote products or services unrelated to this traffic safety course.


Cancellation and Refund Policy

STUDENT may cancel the COURSE within 72 hours from time of registration for a full refund, provided that STUDENT has NOT failed or completed the COURSE. If STUDENT cancels the COURSE after 72 hours, a twenty dollar ($20.00) cancelation fee will be deducted from the refund. To cancel the COURSE, the STUDENT must request a refund by contacting customer service. Upon cancellation, the refund will be processed within fifteen (15) days. NO refund will be given to any STUDENT requesting a refund more than 168 hours from time of registration or who have completed or failed the course.

 

Returned Checks and Chargebacks

Any payments that do not clear whether a credit card chargeback or a returned check will be subject to the following fees. A $20.00 processing fee, payment of an fees charged to COURSE PROVIDER by the bank as well as full payment of the orginal amount due. If these fees are not paid within 5 business days of notification by COURSE PROVIDER, the defensive driving certificate for the account will be voided and the court will be notified of invalid/voided certificate.

 

Circumvention Warning

The STUDENT agrees that HE/SHE, and not any other person, will study the material in its entirety and complete the course questions and the final exam. It is ILLEGAL to attempt to circumvent this online state-approved course or provide false information. If the COURSE PROVIDER discovers that the STUDENT has willfully misrepresented himself or has cheated, the STUDENT will be stopped from taking the course with no refund of the registration fees. In addition, the STUDENT may be prosecuted for perjury and other criminal acts which are punishable by law.

 

Limitation of Liability

STUDENT acknowledges and agrees that the liability of COURSE PROVIDER and their agents and employees for any act, omission to act, or negligence on the part of COURSE PROVIDER and their agents and employees, is strictly limited to and shall not exceed the amount of the registration fee actually paid by STUDENT.

STUDENT understands that for student validation purposes, the COURSE PROVIDER will access one or more public databases in order to extract driver’s license and vehicle registration information. STUDENT authorizes COURSE PROVIDER to access this information under the condition that it be used for the exclusive purpose of student validation.

 

This agreement constitutes the entire contract between the COURSE PROVIDER and the STUDENT, and any oral assurances or promises not contained herein shall not bind the COURSE PROVIDER or the STUDENT. If any provision of this agreement is found by a court of competent jurisdiction to be unenforceable, the remaining terms and conditions shall nevertheless be of full force and effect.  STUDENT further acknowledges that any grievances not resolved by the COURSE PROVIDER may be forwarded to Driver Training, Texas Education Agency, 1701 North Congress Avenue, Austin, Texas, 78701, (512) 936-6777.
